Does Patient Communicator allow bulk texting or SMS?
Yes, however, there are some strict laws that have to be followed.
Bulk texting is not illegal, but it is highly regulated in the United States. If you don't follow specific rules, you can face massive fines ranging from $500 to $1,500 per individual text message sent.
The Golden Rules of Bulk Texting
To stay on the right side of the law (specifically the TCPA and CAN-SPAM Act), you must follow these requirements:
Prior Express Written Consent: You cannot text people just because they are your customers. They must have specifically opted in to receive text messages from you. This is usually done via a checkbox on a web form (that isn't pre-checked) or by texting a keyword to your number.
Identify Yourself: Every message must clearly state that it is from your specific company.
Clear Opt-Out: You must provide a simple way for people to stop receiving texts (e.g., "Reply STOP to unsubscribe"). If someone replies "STOP," you must honor it immediately.
Respect "Quiet Hours": Federal law prohibits sending marketing texts before 8:00 AM or after 9:00 PM in the recipient's time zone.
No "Cold" Texting: It is illegal to buy a list of phone numbers and blast them with texts. You can only message people who have an established relationship with you and have opted in.
